A person commits the offense of criminal possession of marijuana if he or her purposely or knowingly possesses:

  • 60 grams or less of marijuana;
  • 60 grams or more of marijuana.

To convict the Defendant of criminal possession of marijuana, the State must prove the following elements:

1. That the Defendant possessed:

  • 60 grams or less of marijuana;
  • 60 grams or more of marijuana; and

2. That the Defendant acted purposely or knowingly.


Penalties & Fines for Possession of Marijuana

  • 60 grams of marijuana or less (first offense): misdemeanor with a maximum of 6 months in jail and a maximum fine of $500
  • 60 grams of marijuana or less (second offense): misdemeanor with a maximum of 3 years in jail and maximum fine of $1000
  • More than 60 grams of marijuana: felony with a maximum of 5 years in jail and a maximum fine of $50,000
